Inheritance Tax

If you have children it is essential to ensure that the amount of inheritance tax they will be liable to pay in the event of your death is minimised. This is a case where you need to do something to prevent more than is necessary being paid to the taxman.

It isn’t difficult to arrange but it does have to be arranged and we can help. If you do nothing, the Government will get the money.

A couple and one of their fathers discussing the futureIn basic terms, two things can be done:

  1. Rather than paying off your mortgage, put the equivalent value in a life assurance policy that is in trust and pays out on your death to enable your children to pay off the mortgage.
  2. If you are employed and your employer provides Death in Service life insurance cover, typically 4 x Salary, you should consider nominating this benefit into a trust on death, otherwise the value will fall into your estate.

Your Will

It is critical that you make sure you have a will and that it is up to date with your current situation and wishes.

Under current legislation it is possible for two years after the death for terms of the will to be changed to redistribute wealth and alter the beneficiaries, allowing the beneficiaries the ability to access the money but keeping it outside your estate.

If you have not made a will, your estate will be distributed under the rules of intestacy.
